One-Time Hazardous Waste Trading License – GPCB

Regulatory Framework
  • Governed under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, notified by MoEFCC, Government of India.
  • Enforced in Gujarat by the Gujarat Pollution Control Board (GPCB).
What Is the One-Time Hazardous Waste Trading License? This is a regulatory authorization issued by GPCB to individuals or entities (traders, brokers, agents) who are involved in the buying, selling, or facilitating transactions of hazardous waste between generators (industries) and authorized recyclers/reprocessors.

Note: This license does not permit processing or recycling—it only allows trading or brokering of hazardous waste.

Purpose
  • To regulate the trading and movement of hazardous waste.
  • Ensure that waste is transferred only to authorized handlers (e.g., TSDFs, recyclers, co-processors).
  • Avoid illegal dumping, mishandling, or environmental damage.
Who Should Apply?
Entities or individuals involved in:
  • Aggregating hazardous waste from multiple sources
  • Selling or arranging delivery of waste to authorized facilities
  • Acting as intermediaries between waste generators and processors
  • Import/export facilitators (with additional permissions)
Key Requirements for License Application To obtain the One-Time Hazardous Waste Trading License from GPCB, the applicant must:
  1. Register as a trader or broker on GPCB’s XGN portal.
  2. Submit the following:
    • PAN and GST registration
    • Company incorporation certificate or partnership deed
    • Authorized Signatory ID proof
    • Agreement or MoU with generators and recyclers (if available)
    • Details of hazardous waste being traded (category, quantity, form)
    • Consent to Operate/Establish (if office/warehouse is used for storage, which usually is not allowed under this license)
Validity
  • Often issued as a One-Time License, valid for a specific transaction or trading volume.
  • In some cases, GPCB may issue it for a limited validity period (e.g., 1 year), depending on the business model and transaction history.
  Obligations After License Is Granted
  • Ensure manifest system is followed for every shipment.
  • Maintain transaction records.
  • Submit periodic reports to GPCB, if asked.
  • Ensure waste reaches only to CPCB/GPCB authorized recyclers or TSDFs.
  • No storage of waste without separate authorization.
Penalty for Violation
  • Illegal trading without license is punishable under the Environment Protection Act.
  • May lead to:
    • Seizure of material
    • Legal action
    • Ban on future trading activity
