Criteria for Industrial Land Acquisition / Lease

When planning to purchase or lease land for industrial purposes, it is essential to comply with various legal, zoning, and environmental regulations. The following points outline the key criteria and documentation requirements:


 
  1. Siting Criteria as per GPCB Classification
Before proceeding, verify the environmental category of your industry:
  • Green, Orange, or Red category, as defined by the Gujarat Pollution Control Board (GPCB).
Note: Siting criteria is mandatory for all lands except those located in Notified GIDC estates.


 
  1. Zoning Certificate
Check the zoning status of the land based on its jurisdiction:
  • If the land falls under a Gram Panchayat, the zoning certificate must be obtained from the Talati (village-level revenue officer).
  • If the land is within a Municipal Corporation, obtain the certificate from the Nagar Niyojan (Town Planning) Department.
  • If the land is in a Notified GIDC area, neither siting criteria nor zoning certificate is required.

 
  1. Land Use Type as per NA (Non-Agricultural) Order
Check the land use classification in the NA (Non-Agricultural) document:
  • Ensure the land is classified as Industrial or Multipurpose.
  • If the land use is for a specific product or industry segment that does not match your business type, you must apply for change of land use.

 
  1. Lease / Rent Agreement Guidelines (If Applicable)
If acquiring land through lease or rent:
  • The lease period must be more than 7 years to meet regulatory and legal requirements.
  • Review and verify all legal ownership and title documents.
 Mandatory Clause in Agreement: Include the following clause in the Rent / Lease Agreement to ensure environmental responsibility: “The Lessee and the Lessor mutually undertake that both parties shall be equally responsible for any violation of environmental laws at the proposed project site, in accordance with the Gujarat Pollution Control Board (GPCB) Circular No: GPCB/NOC-ARG-291-ID-77384/563016 dated 26/06/2020.”


 
  1. Additional Considerations
  • Verify encumbrance certificate and ensure the land is free from disputes.
  • Check accessibility, infrastructure, and utility availability (electricity, water, road access).
  • Review local development plan to ensure long-term viability.
